The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This follows a court battle that challenged her right to serve.

Acceptance of Resignation

The head of the Justice Department, Pam Bondi, accepted her stepping down on Monday. Bondi stated that the judicial decision made it "untenable" for Habba to lead the department effectively.

"Let no one confuse following the order as giving up," she wrote. "The effort will now extend throughout the nation."

Judicial Challenge

Her resignation was triggered by a federal appellate panel determined that she had been serving in violation of the law as the federal prosecutor. This ruling is likely to affect numerous prosecutions in the state.

The court said that a acting appointment that did not receive confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.

Future Role and Reaction

The Attorney General added that she will remain at the DOJ as a high-level advisor. Habba plans to seek further review of the court's action, in the hope of achieving a different outcome.

Writing online, Bondi contended that the judiciary "cannot be permitted to countermand the appointment of lawyers responsible for performing the primary duty of the administration of enforcing the law."

Record and Legacy

She highlighted her tenure and pointed out that while she was in charge, the city of Newark saw a significant drop in offenses. It was also reported that the Camden recorded its first summer in half a century free from homicides.

Connection to Donald Trump

The 41-year-old attorney, originally became part of Trump's personal legal team in recent years. She went on to defended Trump in his business records case in 2024, leading to his conviction on multiple felony counts of document fraud.

Before Habba took on the top New Jersey post, the former president had announced he was selecting her as his presidential counsellor during his second administration, labeling the lawyer as "unwavering in her loyalty" and a dedicated fighter for justice.
